What are the kinds of fruits? There are three (3) kinds of fruits: natural fruits; civil fruits, and; industrial fruits.
[1] Natural fruits are spontaneous products of the soil and the young and other products of animals. (Article 442 of the Civil Code)
Under the rule partus sequitur ventrem, to the owner of female animals would also belong the young of such animals although this right is lost when the owner mixes his cattle with those of another.
[2] Industrial fruits are produced by lands of any kind through cultivation or labor. (Article 442 of the Civil Code)
Standing trees are not fruits since they are considered immovables although they produce fruits themselves. However, they may be considered as industrial fruits when they are cultivated or exploited to carry on an industry.
[3] Civil fruits are fruits easily prorated for, under Article 544 of the Civil Code, they are deemed to accrue daily and belong to the possessor in good faith in that proportion
REMEMBER! Natural and industrial fruits are real property while still ungathered. Also, only such as are manifest or born are considered as natural or industrial fruits
