Jurisdiction over the Issues

Jurisdiction is the authority to try and decide the issues raised by the pleadings of the parties.
Jurisdiction over the issues in Civil Law is conferred by the pleadings or express consent of the parties. An issue tried but not duly pleaded may be decided upon if no timely objection is made by the parties. In certain cases, as in probate proceedings, jurisdiction over the issues is conferred by law.
