What is movable property?
Article 416 & 417 of the Civil Code provide an incomplete enumeration of examples of movable property. This enumeration is merely a guideline.
[1] Those movables susceptible of appropriation which are not included in the preceding article;
NOTE: This means that those not falling under Article 415 are movable. The process involved is elimination.
[2] Real property which by any special provision of law is considered as personalty;
NOTE: This is movability by legal fiction.
[3] Forces of nature which are brought under control by science;
NOTE: An example of a force of nature that is under control by science is electricity.
[4] In general, all things which can be transported from place to place without impairment of the real property to which they are fixed;
NOTE: This is movability by nature
[5] Obligations and actions which have for their object movables or demandable sums; and
NOTE: This and [6] below is movability by analogy.
[6] Shares of stock of agricultural, commercial and industrial entities, although they may have real estate.
