2006 Bar: What do you mean by (a) real action; and (b) personal action? (2%)


The Rules of Court provides the difference between real actions and personal actions.
The former are actions affecting title to or possession of real property or an interest therein (Fortune Motors, Inc. vs. CA, GR No. 76431, 10/16/1989; Rule 4, Sec. 1). All other actions are personal actions; in other words, personal actions involve the recovery of personal property, the enforcement of a contract, or the recovery of damages.
