Abduction not required in SUBSEQUENT rapes


There can only be one complex crime of forcible abduction with rape. The crime of forcible abduction was only necessary for the first rape. Thus, the subsequent acts of rape can no longer be considered as separate complex crimes of forcible abduction with rape. They should be detached from and considered independently of the forcible abduction. (People vs. Garcia, G.R. No. 141125, 28 February 2002, 378 SCRA 266)
