May kaso ba ang misis na may ibang boyfriend?


Ayon po sa ating Batas Kriminal (Revised Penal Code), krimen ang "adultery." Ito po ang pakikipagtalik ng isang kasal na babae sa ibang lalaki na hindi niya asawa. Kulong po ang abot ng inyong misis kapag napatunayan ninyo ito sa korte.

Maliban po sa aksyong kriminal, maari rin po kayong humingi ng danyos sa inyong asawa at sa boyfriend niya. Maaari po ninyong makumbinsi ang korte na kailangan kayong bayaran ng dalawang ito dahil sa hirap at sakit na dinanas ng inyong kalooban, kasabay ng iba pang mga "injuries" na inyong naranasan.

Bilang panghuli, maaari po kayong mag-file ng kaso for "legal separation." Hindi po mapawawalang bisa ang inyong kasal pero puwede po kayong bigyan ng karapatan ng korte na lumayo sa inyong asawa, itigil ang inyong suporta sa kaniya, makuha ang kotodiya sa inyong anak at iba pang mga bagay na kinakailangan para kayo ay mabigyan ng hustisiya.

Para po makakuha kayo ng ekspertong payo, maaaring magpunta sa pinakamalapit na Public Attorney's Office (PAO).

Act 3815's Article 333. Who are guilty of adultery. - Adultery is committed by any married woman who shall have sexual intercourse with a man not her husband and by the man who has carnal knowledge of her knowing her to be married, even if the marriage be subsequently declared void.

Adultery shall be punished by prision correccional in its medium and maximum periods.

If the person guilty of adultery committed this offense while being abandoned without justification by the offended spouse, the penalty next lower in degree than that provided in the next preceding paragraph shall be imposed.

EO 209's Art. 55. A petition for legal separation may be filed on any of the following grounds: (1) Repeated physical violence or grossly abusive conduct directed against the petitioner, a common child, or a child of the petitioner; (2) Physical violence or moral pressure to compel the petitioner to change religious or political affiliation; (3) Attempt of respondent to corrupt or induce the petitioner, a common child, or a child of the petitioner, to engage in prostitution, or connivance in such corruption or inducement; (4) Final judgment sentencing the respondent to imprisonment of more than six years, even if pardoned; (5) Drug addiction or habitual alcoholism of the respondent; (6) Lesbianism or homosexuality of the respondent; (7) Contracting by the respondent of a subsequent bigamous marriage, whether in the Philippines or abroad; (8) Sexual infidelity or perversion; (9) Attempt by the respondent against the life of the petitioner; or (10) Abandonment of petitioner by respondent without justifiable cause for more than one year.
