Basic Factor in Exercise of Labor Rights

A basic factor underlying the exercise of rights and the filing of claims for benefits under the Labor Code and other presidential issuance or labor legislation is the status and nature of one's employment. Whether an employer-employee relationship exists and whether such employment is managerial in character or that of a rank and file employee are primordial considerations before extending labor benefits.
