MOTION TO DISMISS: Payment, Waiver, Abandonment & Extinguishment

According to Rule 16 of the Rules of Court, that the claim or demand has been paid, waived, abandoned or other extinguished is a ground for a motion to dismiss. This should be read in line with the law on extinguishment of obligation under Article 1231 of the Civil Code of the Philippines.
Under Art. 1231 of the Civil Code, obligations are extinguished:
[1] by payment or performance;
[2] by the loss of the thing due;
[3] by the condonation or remission of the debt;
[4] by the confusion or merger of rights of debtor and creditor;
[5] by compensation; and
[6] by novation.
Obligations may also be extinguished by annulment, rescission, fulfillment of a resolutory condition and prescription.
