[1] Duterte ordered authorities to be more tough on "tambays" (people who loiter or idle around).
[2] The Philippine National Police (PNP), acting on Duterte's order, started arresting tambays, especially within Metro Manila.
[3] Six (6) persons were mistakenly arrested as loiterers when, in fact, they were simply waiting for a friend outside his home.

REYNOLD VILLANIA EXPLAINS ON FACEBOOK THAT DUTERTE'S INITIATIVE IS NOT REALLY ONE AGAINST "TAMBAYS."

Sibak dahil sa maling tambay aresto [Axed for mistakenly arresting loiterers]

[According to news, these two (2) policemen did not know what to do and waited for their superiors after making the arrest. They also said that the President "issued a law" ordering the arrest of "tambays" on the streets.]

[They were removed from their posts because of their illegal manner of effecting the arrest. This is true. We are the police -- law enforcers -- which means that the public expects us to know the law. It is shameful for the public to realize that the police force has wrong understing of the law.]

Saan ba ang problema? Lesson learned: [What is the problem here? What is the lesson learned?]
[First, the term used by the media and the public is "anti-tambay campaign." This is wrong. This gives police arrests a bad name. The correct term is "anti-ordinance violation campaign." This is the true reason for these arrests.]

[Second, when a person is arrested, the arresting officer must know or understand what the violation is. It creates a bad impression in the public's mind when a police officer makes an arrest and asks his superiors what the violation is. This looks like a fishing expedition.]

[Third, never lie and tell people that they are merely being invited to the police station because, legally speaking, this is a form of arrest. Read his Miranda rights. If you don't do this, you may be sued criminally or administratively. The people will lose trust in the police force if you do not keep and follow this advice.]

Therefore, rights of accused under custodial investigation sets in. [Additionally, the designation used by the police for the act done is not what prevails but it is the character of the act. This means that, despite simply "inviting" a person to the police station, a police officer is already making an arrest as far as law is concerned. Therefore, the law on the rights of the accused takes effect.]

[Fourth, the idea that persons are being arrested because the President has ordered a crack down on "tambays" is wrong. They are being arrested on the streets for their violation of local ordinances.]
