PEOPLE OF THE PHILIPPINES V. ARNOLD MONTERAS Y GARCIA
Sirs/Mesdames:
Please take notice that the Court, Third Division, issued a Resolution
dated 10 August 2011, which reads as follows:G.R. No. 190182 (People of the Philippines v. Arnold
Monteras y Garcia). - Considering the allegations, issues and arguments presented in the
appeal, the Court resolves to DISMISS the appeal
for failure to sufficiently show that the Court of Appeals committed any
reversible error in its assailed Decision dated September 15, 2009, as to
warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the
Court ADOPTS the findings and conclusions of law
in the Decision dated September 15, 2009 of the Court of Appeals in CA-G.R.
CR-H.C. No. 03357 and AFFIRMS said Decision
finding appellant Arnold Monteras y Garcia guilty beyond reasonable doubt of
violations of Section 5, Article II of Republic Act 9165, otherwise known as
the Comprehensive Dangerous Drugs Act of 2002, sentencing him to suffer the
penalty of life imprisonment and that appellant is ordered to pay a fine of
Five Hundred Thousand Pesos (P500,000.00), and also of Section 15, Article
II of the same law, sentencing him to suffer the penalty of six (6) months
rehabilitation in a government center subject to the provision of Article
VIII of RA 9165.
