Principles of special complex crimes APPLY to attempted robbery with homicide

Appellant is liable for attempted robbery with homicide even if he was not himself the author of the killing of Generoso Jacob, for lack of evidence showing that he endeavored to prevent such slaying. Thus, the general rule applies that whenever homicide is committed on the occasion or as a consequence of robbery, all those who took part as principals in the robbery shall be held guilty of the special complex crime of robbery with homicide although they did not actually take part in the homicide.
