Law enjoys presumption of constitutionality despite attack in court

The law under which the expropriation is sought, notwithstanding the attack against its constitutionality, remains in force and effective. Admittedly enacted pursuant to the police power of the state, P.D. 1107 has in its favor the presumption of constitutionality that is not easily eroded by a mere allegation of its illegality. Hence, respondent VISCA is entitled to prosecute its expropriation case and be heard on the merits as to the rights that it claims under P.D. 1107. [G.R. Nos. 56219 & 56220. November 27, 1996]
