Alien Workers & Right to Self-Organize

All aliens, natural or juridical, are strictly prohibited from engaging directly or indirectly in all forms of trade union activities. [Art. 284] However, aliens may exercise the right to self-organization and join or assist labor unions for purposes of collective bargaining if the following requisites exist: [1] RULE ON PERMITS. With valid working permits issued by the DOLE; and
[2] RULE ON RECIPROCITY. They are nationals of a country which grants the same or similar rights to Filipino workers.

Compliance with the rule on reciprocity may be certified by DFA. This certification may be dispensed with if the country in question has ratified either ILO Convention No. 8 and ILO Convention No. 98 [Book V, Rule II, Sec. 2]
