Gov't sues small companies for tax crime but BIR ordered to stop collecting Pacquiao's P3.3B deficiency

Among those charged before the Department of Justice for violation of Sec. 255 of the Tax Code are:

[1] Transport company Citistar Transport for tax deficiencies amounting to P3.66 million for 2011;
[2] Business process outsourcing company GCS Agents for tax deficiencies amounting to P92.34 million for 2011;
[3] Computer software company I.T. Citi Services for tax deficiencies amounting to P3.06 million for 2008;
[4] General building contractor MAVIMA Group for tax deficiencies
amounting to P54.01 million for 2012;
[5] Janitorial service-provider Sparrow Integrated for tax deficiencies
amounting to P21.50 million for 2008;
[6] Retailer and wholesaler Uniwide Sales for tax deficiencies amounting to P84.27 million for 2012;
[7] wholesaler and distributor Wye Marketing for tax deficiencies
amounting to P71.74 million for 2009; and
[8] Textile manufacturer, importer and exporter Yarntech for tax
deficiencies amounting to P104.98 million for 2013.

The Court of Tax Appeals (CTA) has directed the Bureau of Internal Revenue (BIR) to “cease and desist” from collecting the P3.29-billion alleged tax deficiency of Sen. Manny Pacquiao and wife Jinkee for years 2008 and 2009 pending decision on the senator’s petition questioning the BIR’s assessment.

In a 38-page resolution promulgated last July 27, the tax court’s First Division said the BIR committed “several violations and irregularities” when it issued its Final Decision on Disputed Assessment (FDDA) in which it said that Pacquiao and his wife have a total of P3.29 billion in unpaid tax obligations.
