Obligacion solidaria

An obligation where there is concurrence of several creditors, or of several debtors, or of several creditors and several debtors, by virtue of which, each of the creditors has the right to demand, and each of the debtors is bound to render, entire compliance with the prestation which constitutes the object of the obligation (obligacion solidaria).

According to Tolentino, each debtor is liable for the entire obligation (solidary debtor or passive solidarity), and each creditor is entitled to demand the entire obligation (solidary creditor or active solidarity). Solidarity may exist although the creditors and the debtors may not be bound in the same manner and by the same periods and conditions. (Article 1211 of the New Civil Code of the Philippines)
