SC issues TRO vs NCAP

The Supreme Court En Banc (“Court”), during its session today, 30 August 2022, acted on the following matter:

In G.R. No. 261892 (Kilusan sa Pagbabago ng Industriya ng Transportasyon, Inc. [KAPIT], et al. v. City of Manila, et al.) and G.R. No. 262192 (Atty. Paa v. Sangguniang Panglungsod ng Manila and Mayor Lacuna- Pangan), the Court resolved, and without necessarily giving due course to the Petitions, to:

Issue a temporary restraining order (TRO), effective immediately and until further orders from the Court, enjoining all respondents from the implementation of the No Contact Apprehension Policy (NCAP) programs and ordinances related thereto. The Court also said that any apprehensions through the NCAP programs and ordinances related thereto shall be prohibited until further orders from the Court;

Issue a TRO, effective immediately and until further orders from the Court, enjoining the Land Transportation Office and all parties acting on its behalf from giving out motorist information to all local government units, cities, and municipalities enforcing NCAP programs and

The case was also set for oral arguments in the afternoon of 24 January 2023.

The Supreme Court Public Information Office (SC PIO) will upload the pertinent Resolution in the SC website once it receives an official copy from the Office of the Clerk of Court En Banc.

Likewise, the SC PIO will be creating a microsite in the SC website in connection with the case and where the public may access and view all pertinent pleadings.
