Before whom may depositions be taken? Outside the Philippines


Deposition can be taken within or without the Philippines. If outside the Philippines, deposition may be taken before the following persons:

[1] On notice, before a secretary of embassy or legation, consul-general, consul, vice-consul, or consular agent of the Philippines (Rule 23, Sec. 11); or
[2] Before such person or officer as may be appointed by commission or letters rogatory; or
[3] Any person authorized to administer oaths, as stipulated by the parties in writing. (Rule 23, Sec. 14)
