Jurisdiction over the Parties


[1] The manner by which the court acquires jurisdiction over the parties depends on whether the party is the plaintiff or the defendant.
[2] Jurisdiction over the plaintiff is acquired by his filing of the complaint or petition and the payment of correct docket fees. By doing so, he submits himself to the jurisdiction of the court.
[3] Jurisdiction over the person of the defendant is obtained either by a valid service of summons upon him or by his voluntary submission to the court's authority. [4] The mode of acquisition of jurisdiction over the plaintiff and the defendant applies to both ordinary and special civil actions.
