Violation of custodial investigation rights makes evidence obtained inadmissible

The custodial interrogation of accused-appellant was violative of Section 12, Article III of the Constitution. The Constitution provides that (3) Any confession or admission obtained in violation of this section or Section 17 hereof shall be inadmissible against him. Section 17, Article III provides: No person shall be compelled to be a witness against himself. Any confession, including a re-enactment without admonition of the right to silence and to counsel, and without counsel chosen by the accused is inadmissible in evidence (People vs. Duero, 104 SCRA 379 [1981]).
